Acceptance of terms
By using Barqia (operated by Murtadha Abdulrahim Al-Haddad Trading Establishment) you agree to these Terms and to the Privacy Policy. If you use the service on behalf of a business, you confirm you are authorised to bind it.
The service
Barqia provides WhatsApp conversation management, campaigns and automation, an agent inbox, catalog and forms, and store integrations, through Meta's official WhatsApp Business Platform.
Acceptable use
You will comply with WhatsApp and Meta policies including the Messaging Policy, obtain customer consent before messaging, and not send spam or violating/illegal content. You may not send patient health-record content — diagnoses, test results, medical reports or prescriptions — through the platform. You are solely responsible for the content sent through your account and for your approved templates.
Merchant responsibilities
You are the controller of your customers' data: you ensure a lawful basis and opt-in consent, accurate contact data, and a lawful purpose, and you honour opt-out requests.
Subscriptions & VAT
Plan prices are shown before VAT; VAT is added at checkout at the statutory rate then in force — the rate applied is shown on the pricing page and on the simplified tax invoice issued for each transaction. Subscriptions renew automatically unless cancelled before the period ends. For stores connected via the Zid App Market, collection is handled through Zid under the partner agreement.
AI assistant & per-conversation billing
The AI assistant is metered by conversations, not messages: one “AI conversation” per customer within a daily window in which the AI replies at least once, up to your monthly quota. When exhausted, automatic replies pause until renewal or an add-on, with a fair-use cap on replies within a single conversation. AI answers may vary and remain the merchant's responsibility to review.
Data protection
Personal data is processed per the Privacy Policy and the PDPL. Where we process your end-customers' data we act as processor on your behalf, and that processing is governed by the Data Processing Agreement published at barqia.net/dpa, which forms an integral part of these Terms and is accepted when they are. Suspension & termination
We may suspend or terminate an account on breach of these Terms or WhatsApp/Meta policies, or on misuse, with notice where possible. You may cancel your subscription at any time.
Disclaimers & limitation of liability
The service is provided “as is.” Message delivery depends on Meta/WhatsApp and may be subject to their policies and rate limits. To the extent permitted by law, we are not liable for indirect or consequential damages.
